Former President Trump's Team Asks Supreme Court Permission to Fire Leading Copyright Director

The ex- leader's administration on Monday petitioned the nation's highest court to permit the termination of the director of the US Copyright Office.

This urgent appeal follows about a month and a half after a federal appeals court in Washington decided that the director, Shira Perlmutter, cannot be unilaterally dismissed.

Nearly four weeks prior, the full District of Columbia appeals court declined to reconsider that ruling.

This case is the most recent in a line of disputes concerning executive authority to place chosen leaders at government agencies.

The Supreme Court has mostly allowed such actions, even as court challenges proceed.

However, this specific case concerns an office within the national library. Perlmutter acts as the copyright registrar and also counsels Congress on copyright matters.

The government's top lawyer, D John Sauer, argued in the legal document that, despite ties to Congress, the director “exercises administrative authority” in regulating copyrights.

Perlmutter alleges she was terminated in May because the former president disapproved with recommendations she gave to Congress in a report concerning AI.

She allegedly got an email from the administration informing her that her position was “terminated effective at once,” according to her office.

A divided appellate panel ruled that Perlmutter could retain her position while the legal dispute moves forward.

“The administration's alleged obvious interference with the work of a Legislative Branch official, as she carries out legally approved duties to counsel Congress, appears to be a breach of the division of government authority,” stated Judge Florence Pan for the appellate panel.

Justice J Michelle Childs supported the opinion. Both justices were nominated to the appellate court by Democratic leader Joe Biden.

In opposition, Justice Justin Walker, a former president's nominee, wrote that Perlmutter “exercises administrative power in a host of manners.”

Perlmutter's lawyers have contended that she is a renowned copyright specialist. She has acted as copyright director since former librarian of Congress Carla Hayden appointed her to the position in October 2020.

The former president named assistant attorney general Todd Blanche to replace Hayden at the Library of Congress. The White House had dismissed Hayden following complaints from right-leaning groups that she was advancing a “progressive” program.
